India: Statement of the Right to Food Campaign against the repeated police firings in Jharkhand

We condemn the repeated firing by Jharkhand police on people’s struggles against displacement in the villages of Gola, Badkagaon and the town of Khunti

Right to Food Campaign strongly condemns the violence unleashed by the Jharkhand Government on tribals which has resulted in the deaths of 7 persons and injuring more than 80 persons in the last two months. Adding on to the suffering of the people, large numbers of innocent people have also been arrested, criminalising people’s peaceful resistance movements and undermining democracy.

These incidents over a period of less than two months have completely exposed the anti-people and pro-corporate face of the Raghubar Das BJP Government. This is also in line with complete support being extended by BJP led governments in Madhya Pradesh, Jammu and Kashmir, Jharkhand, Gujarat to trigger-happy security forces and the shameless promotion of corporate profiteering in the name of development at the cost of life and livelihood of the people. The Chief Minister of Jharkhand also gave a blatant, unlawful violent threat to those opposing the amendments in Chotanagpur Tenancy Act and Santhal Pargana Tenancy Act(CNT-SPT)by giving a statement that all those who stand against these amendments will be beaten up.

The killings at Gola, Ramgarh took place on the 29th of August, at the Inland Power’s plant as villagers were protesting the displacement which was to follow soon after as Inland Power a subsidiary of Inland World Logistics wanted the land for the installation of the second unit 63 MW coal-based thermal power plants near Gola, where police firing resulted in the death of two persons.

Similarly in, Badkagaonblock of Hazaribagdistrict four people were killed in a police firing on the 1st of October where people were protesting the acquisition of land and displacement by National Thermal Power Corporation for their Pakri-Barwadih coal mine. Till now several persons have been killed in Badkagaon due to police firing. On 23rd June 2013 one person was killed and then on 14th August, 2015 many people were injured. The Pakri-Barwadih project has been mired in controversies from day one when the mine was allotted in the year 2004 and when construction work started in 2006. People have been opposing the project in their area from the day the mine was allotted and haven’t moved despite the compensation having been increased. Heavy repression has continued from day one. The mine was allotted to NTPC as a Captive mine for its Power Plant. But the entire project was outsourced to one Australian company named Thiess India/Minecs, a subsidiary of Thiess Private Limited, a subsidiary of Leighton Holdings (Australia). Later citing reasons for delay in developing the mine the contract was cancelled by NTPC and awarded to Thriveni-Sainikcompany. This, for all practical purposes, is nothing short of privatization of the mine, while keeping a Public Sector Company as the face.

Then on the on 22nd Oct, when people were protesting the BJP government’s ordinance to amend the CNT-SPT Acts, which have been in existence since the British periodto protect the lands from outsiders. Adivasis from Khunti were going to Ranchi to protest against these amendments and to unitedly resist this ordinance. Government disallowed this unity and in the police firing one person was killed and at least ten people were injured on 22nd Oct 2016.

The three separate incidents only show the cruel face of the State. It also shows the status of the tribals in Jharkhand, even after 15 years of its formation. The campaign condemns the reign of terror which has continued in the villages of Badkagaon even after the 1st October incident. It has been reported that since 1st October the police and rapid action force (RAF) continue to wage violence on innocent villagers. People are being picked up randomly on the pretext that they were part of the agitation. In the fear of police violence a number of families have fled from the villages or have sent the women and children somewhere else.

At the heart of the recent killings is the State’s bid to forcefully acquire land for setting up infrastructure projects, mining and the state’s own discomfort with the laws governing and protecting the rights of the tribals over their land, water, forests and minerals. The State Government has been in the process of bringing major amendments in CNT-SPT Acts, which will facilitate the easy conversion of tribal land for non-agricultural uses paving the way for easy acquisition.

There is a growing unrest in Jharkhand today and what is obvious is the large scale social unrest, which will only lead to more deaths and killings. The Tribals in the state are already facing acute hunger and the deaths and further bid of conversion of agricultural land for non-agricultural purposes is only going to make the situation worse. The recent Rapid Survey on Children of the Government of India shows that 53% Adivasi children in Jharkhand are malnourished (stunted) and 41% adolescent girls have a low body mass index.

The Right to Food Campaign strongly opposes any forced land acquisition by the government. The campaign believes that ensuring food security in a comprehensive manner includes protecting people’s ownership over natural resources (Forest, Land, Water and Minerals). The Gola and Badkagaon killings have once again proved that the present Governments both at the State and the Centre are more concerned with supporting corporate profits by aiding them in taking away natural resources from people rather than working towards protecting people’s rights over resources and livelihoods.

The Campaign is also against the present model of development wherein, in the name of power generation, multi-crop agricultural lands are being acquired, which goes not only against the rights that the people have over natural resources but also are a threat to food security and food sovereignty.

The Right to Food Campaign extends solidarity to the ongoing peoples’ resistance in Jharkhand including in Badkagaon and demands that:

· The Government must listen to the demands of the people and ensure that pro-company changes are not made to the CNT and SPT acts.

· The opposition of the people to the various ongoing projects in Gola and Badkagaon, must be paid heed to and a resolution within the framework of the law be found.

· Forcible land acquisition and mining should be halted immediately and Gram Sabha and project affected people’s consent must be sought as per the Land Act 2013, Forest Rights Act, CNT and SPT Acts, as and where its applicable.

· A fair judicial enquiry, by a sitting Supreme Court judge, should be instituted in order to examine the three incidents of police firing. This enquiry must be conducted speedily.

· The policemen responsible for the deaths must be booked urgently, as stated by the Supreme Court through its various orders, which can only put a check to the trigger happy police force.

· The family members of deceased and injured should be paid adequate compensation.

· The unconditional release of all prisoners picked up subsequent to these firings.

रोज़ी रोटी अधिकार अभियान का ठारखंड के गोला, बड़कागाठव और खूंटी में विसॠथापन का विरोध कर रहे लोगों पर हॠई गोलाबारी की कड़ी निंदा करता है

रोज़ी रोटी अधिकार अभियान पिछले दो महीनों में ठारखंड सरकार दॠवारा आदिवासियों पर हॠई हिंसा, जिसके कारण सात लोगों की मौत हॠई और 80 लोग घायल हॠठ, की कड़ी निंदा करता है. साथ ही साथ, कई बेकसूर लोग गिरफॠतार भी किठगठहैं, जिससे लोगों के शांतिपूरॠवक पॠरतिरोध के आनॠदोलनों का अपराधीकरण हो रहा है और लोकतंतॠर दॠरॠबल हो रहा है.

इन घटनाओं ने रघॠबर दास की बीजेपी सरकार का जनता-विरोधी व कंपनी-समरॠथक पॠरकृति का खॠलासा किया है. रघॠवर सरकार ने मधॠय पॠरदेश, जमॠमू व कशॠमीर और गॠजरात में बीजेपी सरकारों की तरह सॠरकॠषा बलों को खॠली छूट दे रखी है और विकास के नाम पर कंपनियों को अंधाधॠंध मॠनाफ़ा कमाने में सहयोग कर रही है.

गोला, रामगॠमें 29 अगसॠत को इनलैंड पावर पॠलांट में हॠई गोलीबारी में दो लोगों की जाने गई. घटना सॠथल पर लोग इनलैंड पावर दॠवारा 63 मेगावाट कोयला आधारित थरॠमल पावर पॠलांट का दूसरा यूनिट सॠथापित करने के लिठली गई ज़मीन से होने वाले विसॠथापन का विरोध कर रहे थे.

उसी पॠरकार, 1 अकॠटूबर को हजारीबाघ के बड़कागाठव में पॠलिस दॠवारा हॠई गोलीबारी में चार लोग मारे गठ. यहाठलोग नैशनल थरॠमल पावर पावर कॉरॠपोरेशन (NTPC) दॠवारा पकरी-बरवाडीह कोयला खदान के लिठली गई ज़मीन और उससे हॠठविसॠथापन का विरोध कर रहे थे. बड़कागाठव में पहले भी हिंसा हॠई है; ठक वॠयकॠति की 23 जून 2013 को मृतॠयॠहॠई थी और 14 अगसॠत 2015 को कई लोग घायल हॠठथे. पकरी-बरवाडीह की कोयला खदान का 2004 में आवंटन हॠआ था और 2006 में निरॠमाण कारॠय शॠरू हॠआ था. परनॠतॠयह परियोजना शॠरू से ही विवाद में फसी है. खदान के कॠषेतॠर में लोगों को जबरन हटाने के लिठदमन का पॠरयोग हो रहा है. यह खदान NTPC को आवंटित की गई थी, पर NTPC ने इसे ठक ऑसॠटॠरेलियन कंपनी को सौंप दिया. पर जब इस विदेशी कंपनी ने खदान पर काम नहीं किया, तो NTPC ने खदान को तॠरिवेणी-सैनिक नाम की कंपनी को दे दिया. इस पॠरकार इस खदान का निजीकरण हॠआ है.

22 अकॠटूबर को रांची में बीजेपी सरकार दॠवारा कंपनियों को आदिवासियों की ज़मीन बेचने के लिठछोटानागपॠर टेननॠसी कानून और संथाल परगना टेननॠसी कानून में परिवरॠतन लाने के लिठपॠरसॠतावित अधॠयादेश का विरोध करने के लिठराजॠय भर से आदीवासी इकॠकठा हॠठ. परनॠतॠ, विरोध के लिठअनॠय ज़िलों से आई कई गाड़ियों को रांची घॠसने ही नहीं दिया. खूंटी में पॠलिस दॠवारा हॠई गोलीबारी में ठक वॠयकॠति की मौत हॠई और कम से कम दस लोग घायल हॠठ.

यह घटनाठं ठारखंड सरकार की कॠरूरता और राजॠय के गठन के 15 सालों बाद उसके आदिवासियों की सॠथिति ठलकाता है. रोज़ी रोटी अधिकार अभियान बड़कागाठव के गाठवों में गोलीबारी के बाद भी लोगों पर हो रही हिंसा की कड़ी निंदा करता है. लोगों को उठाया जा रहा है यह कहकर कि इनॠहोने विरोध में भाग लिया था. इस भय के माहौल में कई लोग अपने गाठव छोड़कर चले गठहैं.

इन सब हिंसातॠमक घटनाओं का कारण है सरकार का कंपनियों को देने के लिठजबरन भूमि अधिगॠरहण करना और आदिवासियों का उनके जल जंगल जमीन के ऊपर नियंतॠरण रखने के लिठबनाठगठकानूनों से आपॠपतॠति.

ठारखंड में बने इस अशांति के माहौल से केवल और हिंसा और मौते होंगी. राजॠय के आदीवासियों में वैसे ही भॠखमरी और कॠपोषण का सॠतर बहॠत गंभीर है. खेतिहर ज़मीन का गैर-कृषि उदॠदेशॠयों के लिठपॠरयोग से खादॠय असॠरकॠषा बॠेगी.

रोज़ी रोटी अधिकार अभियान सरकार दॠवारा किठजा रहे जबरन भूमि अधिगॠरहण का सॠपषॠट रूप से विरोध करता है. अभियान यह मानता है कि वॠयापक खादॠय सॠरकॠषा के लिठलोगों का उनके संसाधनों (जल, जंगल, ज़मीन और खनिज) पर सॠवामितॠव की रकॠषा ज़रूरी है. अभियान इस विकास के मॉडल के भी विरॠदॠध है जिसमें बिजली उतॠपादन के नाम पर बहॠ-फसला खेती का अधिगॠरहण हो रहा है. यह न केवल लोगों के उनके पॠराकृतिक संसाधनों पर अधिकारों का हनन है, पर खादॠय सॠरकॠषा और खादॠय संपॠरभॠता को भी खतरे में डालता है.

रोज़ी रोटी अधिकार अभियान ठारखंड में चल रहे जन आनॠदोलनों का समरॠथन करता है और निमॠन मांगे रखता है:

· सरकार छोटानागपॠर टेननॠसी कानून और संथाल परगना टेननॠसी कानून में कोई ठसा परिवरॠतन न करे जिससे कंपनियों दॠवारा आदिवासियों की ज़मीन हड़पना आसान हो जाठ.

· लोगों के गोला और बड़कागाठव में चल रही परियोजनाओं के विरोध पर अमल किया जाठऔर इन विवादों का कानून के दायरे में समाधान ढूठढा जाठ.

· जबरन भूमि अधिगॠरहण और खनन पर तॠरंत रोक लगे और भूमि अधिगॠरहण, पॠनरॠवास व पॠनःसॠथापन कानून, पेसा कानून, वन अधिकार कानून, छोटानागपॠर टेननॠसी कानून और संथाल परगना टेननॠसी कानून के अनॠसार गॠराम सभाओं व परियोजनाओं से पॠरभावित लोगों की सहमति ली जाठ.

· जिन पॠलिसकरॠमियों दॠवारा चालाई गई गोलियों से लोगों की मौते हॠई हैं, उनपर सरॠवोचॠच नॠयायालय के आदेशों के अनॠसार कारॠरवाई हो.

· मरे और घायल हॠठलोगों के परिवारों को परॠयापॠत मॠआवज़ा मिले.

· इन गोलीबारियों के बाद कैद किठगठसब लोगों को रिहा किया जाठ.
